إن الغاية الأساسية للقضاء هو ضمان الحماية القانونية للناس كافة، فالقضاء هو المرفق الذي يلجأ إليه المتخاصمين عندما يثور النزاع بينهم، وتشتد الخصومة إزاء قضية بعينها، وهذا يتوجب أن يسلك المتخاصمان الطريق الذي رسمه القانون وحدد إجراءاته. وإزاء ذلك فإن القانون المدني العراقي وتشريعات قانونية أخرى، قد ألزمت من له الحق في القيام بعمل أو تصرف أن يستأذن المحكمة المختصة للقيام بهذا العمل أو ذلك التصرف مستنداً في ذلك إلى نص قانوني يخوله هذا الطلب.
وفي هذا الكتاب يقف القاضي "لفته هامل العجيلي" / نائب رئيس محكمة إستئناف بغداد الرصافة / الإتحادية؛ على الأذونات القضائية التي تضمنتها نصوص القانون المدني العراقي والقوانين الأخرى، ويفعل ذلك من خلال إحصاء تلك النصوص في القوانين المشار إليها (القانون المدني) حسب تسلسل موادها في ذلك القانون وذلك بالعمل على إيراد نص المادة أو الفقرة من المادة التي تضمنت وجوب حصول إذن المحكمة قبل القيام بالعمل أو التصرف المأذون به وشرح مضمونها وإيراد التطبيقات القضائية في حالة وجودها.
ولمزيد من التفصيل تم للمؤلف عرض الأذونات القضائية التي تضمنها القانون المدني العراقي ومنها قانون النقل وقانون التجارة وقانون الأحوال الشخصية للأجانب، والأذونات التي تقدم إلى المحكمة المختصة والتي يُتخذ فيها الإذن القضائي على أصل الطلب باعتبار ذلك من (الأوامر الولائية) وليس من القضاء المستعجل ... وموضوعات أخرى ذات صلة.
