لم ينل عقد المغارسة إهتماماً ملحوظاً في الدراسات القانونية رغم أهميته الإقتصادية في كونه من عقود الإستثمار الزراعي والتي لم تجد لها مكانة مرموقة في إطار الإستثمار الإقتصادي التي تتبناه الدول العربية.
ولقد عالجت معظم القوانين المدنية العربية عقد المغارسة، ولكن ليس بوصفه عقداً مستقلاً، وإنما في إطار صورة أخرى، كما هو حال القانون المدني العراقي والذي عالجه ضمن أنواع مختلفة من الإيجار، ووضعه قانون الإصلاح الزراعي تحت مسمى العلاقة الزراعية.
إلا أن الأحكام التي تناولت عقد المغارسة في قانون الإصلاح الزراعي وما رتبه من حقوق وإلتزامات على الطرفين تجعل منه عقداً مستقلاً ويجب أن ينظر إليه بهذا الوصف، وقد تناولنا في هذا الكتاب التنظيم القانوني لعقد المغارسة من حيث التعريف والخصائص والطبيعة القانونية وحقوق وإلتزامات الطرفين وكيفية إنهائه وتسجيله والإختصاص القضائي له في إطار دراسة تحليلية وافية.
