وائل حلاق (ولد 1955 م) هو باحث فلسطيني الأصل، كندي الجنسية، مسيحيّ الديانة، متخصص بالقانون وتاريخ الفكر الإسلامي، يعمل كأستاذ علوم اجتماعية في جامعة كولومبيا - قسم دراسات الشرق الأوسط. التحق حلاق بعد حصوله على شهادة الدكتوراة من جامعة واشنطن بمعهد الدراسات الإسلامية بجامعة مكغيل وعمل كأستاذ مساعد بالقانون الإسلامي عام 1985 م. نال درجة الأستاذية عام 1994م. يعتبر حلاق مؤلف ومحاضر واسع الإطلاع إذ لديه الكثير من الاسهامات بمجال الدراسات الإسلامية. ترجمت أعماله إلى عدة لغات منها العبرية والإندونيسية والإيطالية واليابانية والتركية. في عام 2009 م قد تم تصنيف حلاق ضمن أكثر 500 شخصية مسلمة تأثيراً على مستوى العالم.

في سياق الجدل المستمرِّ حول علاقة الشريعة بالقانون والأخلاق، يصبح من المهمِّ استنقاذ النقاشات من حمولات التأطير السياسي، وردّها إلى ساحة الفكر والنقاش المنهجي.
ومن هنا، كانت فكرة هذا الكتاب، الذي يتضمن أربع دراسات تنبع أهمّيتها من كونها إسهاماً في النظرية الدستورية والسياسية معاً، وتسهم بقوةٍ في البحث عن إجابةٍ للأسئلة المركزيّة عن طبيعة "نظام الحكم" في الإسلام - لا بمعنى الإطار الدستوري فقط، بل بمعنى معايير الحكم على الحقِّ والباطل والحلال والحرام والصلاح والفساد والمصلحة والضرر وغيرها، كما تراجع تصوّرات نظام (الحكم) بمعنى تقسيم السلطات وموضع الفقه من القانون والوشائج التي تجمعهما في التصوُّر الإسلامي، وهي كلها أطرٌ فكرية لازمة قبل السعي إلى الإجتهاد في الصيغ العملية - المؤسسية والتصحيحية للواقع العربي والإسلامي نحو أنظمة عدالةٍ أكثر شمولاً وفاعلية.
ينتقل القارئ - في هذا الكتاب - من مراجعة إفتراضات جوزيف شاخت ونقدها في الفصل الأول، إلى صياغة رؤية للدستورية الإسلامية ومنظمة الحكم في الفصل الثاني، ثم عودة - في الفصل الثالث - إلى إطلالة على المنهج الأصولي في فهمه لمرجعية القرآن الكريم والحجج التي يسوقها الشاطبيُّ في الردّ على مخالفيه، إلى موضوع يطرح تساؤلات كثيرة حول إمكانية إحياء الشريعة وذلك في الفصل الرابع.
