يعد موضوع البحث من أهم مسائل التجارة الدولية في ظل عولمة أسواق رأس المال، حيث عقدت منظمة التجارة العالمية اتفاقاً حول تحرير الخدمات المالية وقعته سبعون دولة في 13 ديسمبر 1997م بجنيف، وقضي هذا الاتفاق بتحرير النشاط المالي في مجالات البنوك، والتأمين، والسمسرة في الأوراق المالية. ولتلك الأهمية كان اختيارنا لموضوع البحث، للوقوف علي التنظيم القانوني لعمليات البورصة ذات الطابع الدولي في الدول العربية لمعرفة مدى مسايرتها لتشريعات الدول الأخري وبالذات المتقدمة منها، ومعرفة مكامن القوى والقصور فيها. ومن ناحية أخري فإن موضوع البحث لم يلق اهتمام الباحثين في الوطن العربي لندرة المراجع والدراسات والأبحاث المتعمقة والتأصيلية والنقدية في هذا المجال، وهذا راجع إلي صعوبة البحث فيه. بالإضافة إلي حاجة المشرع والقاضي والمحامي والباحث في الوطن العربي لهذا البحث الذي يطرق لأول مرة، وذلك للاستفادة منه في حياتهم العلمية والعملية.
