تناولت الدراسة مشكلة القياس وأثره في إثبات كثير من أحكام الأحوال الشخصية، وتخريج بعض المسائل المعاصرة وفق المذهب الحنفي.
فتعرّفت الدراسة على مفهوم القياس وأركانه وأقسامه، وبيّنت الأسباب التي أثّرت في منهج الحنفية في القياس وأثبت أحكام الزواج، وعرضت بالتحليل والمناقشة الفرقة وآثارها، وأظهرت كثير من أحكام الرضاعة والحضانة التي ثبت حكمها بالقياس وبيّنتها بما يَسهل الرجوع إليها والإفادة منها وفهمها بما يتناسب والعصر الحاضر.
واعتمدت الدراسة على المنهج الإستقرائي التحليلي والإستنباطي وذلك بإستقراء وتحليل أغلب أقوال الحنفية فيما يتعلق بأثر القياس في إثبات أحكام الأحوال الشخصية، ودراستها دراسة عميقة وإستخلاص النتائج.
وكان من أهم النتائج التي توصّلت الدراسة إليها أن القياس مصدر التجدد في الفقه الإسلامي، وأن لمنهج الحنفية في القياس الأثر البالغ في إثبات كثير من مسائل الأحوال الشخصية والتعامل مع المسائل المعاصرة.
