يعد التلوث البيئي بالنفايات الخطرة من المواضيع المهمة والحديثة والتي حظيت بإهتمام واسع على المستويين الدولي والإقليمي، لإعتباره إحدى الملوثات التي تهدد البيئة والصحة الإنسانية، فهي ناتجة عن التقدم الصناعي المذهل خاصة في دول الإتحاد الأوروبي والولايات المتحدة، وسائر الدول المتقدمة صناعياً، لإستخدامها الطاقة النووية والمواد الكيميائية والإكتشافات العلمية الحديثة في مختلف صناعاتها، حيث ينتج عن هذه الصناعات كميات كبيرة من النفايات الخطرة والسامة والتي تحمل خصائص تؤدي إلى التدهور السريع للبيئة والتأثير في صحة الإنسان، إذا لم يتم التخلص من تلك النفايات بطريقة قانونية وفنية تقوم على قواعد سليمة.
وتعتبر النفايات الخطرة من أهم وأخطر المشاكل التي تواجه الجنس البشري بعد مشكلة سباق، التسلح النووي، لا سيما بعد أن ثبت أنه ليس هناك أحد بمأمن من أضرارها، ومخاطرها، وتأثيرها على البيئة والصحة البشرية، إضافة إلى أن ضررها بات يتعدى حدود البلد الواحد ليغدو ضرراً عاماً شاملاً لدول العالم جميعها نتيجة إتباع دول العالم المتقدمة سياسة إلقاء النفايات الخطرة في أراضي دول العالم الثالث وبحاره، مما جعلها مشكلة عالمية تمثل أكثر التحديات التي تواجه المجتمع الدولي في هذه الأيام.
وتمثل إتفاقية، بازل 1989 الصك القانوني الوحيد على المستوى العالمي، الذي يتناول نقل النفايات الخطرة عبر الحدود الدولية وإدارتها بشكل سليم بيئياً.
