إذا كان طرفى النزاع جعفريا المذهب فإن القانون الواجب التطبيق على الدعاوى الشرعية المرددة بينهما هى أحكام المذهب الجعفرى سواء كان النزاع سابقا على تاريخ العمل بقانون الأحوال الشخصية رقم 51 لسنة 1984 أو لاحقا عليه. وفى هذا الإطار ذهب قضاء محكمة التمييز إلى أن الأمور المتعلقة بالعقيدة الدينية إنما تتأتى الأحكام فيها على الاقرار بظاهر اللسان متى كان ظاهر الحال لا يكذبه، ولا ينبغة للقضاء بحث دواعيها، بل يقتصر على بحث النتائج المترتبة طبقا لأحكام الدين أو المذهب التى يعتنقه الشخص.
