إن الفقه الإسلامي، بوجه عام، وخصائص تشريعه، بوجه خاص، لم يعالج أي منهم بالاستقراء والتحليل المنطقي، موضوعاً أو حكماً ومقصداً، معالجة تنفذ إلى الفلسفة التشريعية التي تنهض عليها مبادؤه العامة وأصوله الكلية، بحيث يستشف الباحث ما يستكنّ وراءها من الحكمة التشريعية التي ينبغي أن تتحرى، لتتبين، باعتبارها قوام إرادة المشرع من النص وحكمه، والغاية التي من أجلها شرع، لكونها تمثل المصلحة والعدل، ومن هنا وجب أن يحدد على ضوئها مدلول النص، أو مفهوم المبدأ، ويعيّن مجال تطبيقه، ضيقاً وسعة، لتحقيق تلك "الحكمة" في كافة مظان وجودها عملاً لما تقدم من أنها غاية المشرع من الحكم. والمنهج الأصولي في الاجتهاد التشريعي يفرض اعتبار الظروف في الاستدلال، لما لها من أثر في تشكيل الحكم، ومما لا ريب فيه أن للظروف الملابسة، للأشخاص، أو للوقائع والأحداث، أثراً في تشكيل علة الحكم السياسي وتوجيه الاستدلال ودليله، وتبين مسالك تطبيقه، ضماناً لمشروعية نتائجه، إذ العبرة بالنتائج العملية، الواقعة أو المتوقعة. وبحث في هذا الكتاب يدور في هذا المجال، في محاولة للوصول إلى خصائص التشريع الإسلامي في السياسة والحكم لتيسير فهمه، وتوضيح كثير من مقرراته الفقهية، وعناصر استدلالته الأصولية من خلال المعطيات الحالية وذلك لما يفرضه المنهج الأصولي في الاجتهاد التشريعي، من أن يكون للظروف المتغيرة الملابسة اعتبار ووزن في الاستدلال، ولا سيما ظروف هذا العصر الذي نعيشه، لتعقدها، بحيث تفتقر إلى خبرة علمية متنوعة تبعاً لطبيعتها، لتحليلها وتبنيها، بما ينشأ عنها من دلائل تكليفية أخرى يقتضي أحكاماً اجتهادية، إذ التشريع للواقع، بظروفه وملابساته المتغيرة، يدبر أمره بما يمسك عليه من كيانه، ويجنبه أسباب الضعف والتهافت والانهيار.
