باستعراض نصوص قانون العقوبا المصري نجد انه قد قم تبويبه إلى اربعة كتب على ما ورد بالنصوص، وان تلك الكتب الأربعة قد قسمت إلى أبواب، ومن ثم فإن المشرع لم ينهج نهج الفصول كما كان متبعاً عند معالجته قانون الإجراءات الجنائية حتى أنه عند عرض الباب الثالث المتعلق بالعقوبات لم يتم تقسيمه إلى فصول بل قام بتقسيمه الى ثلاث اقسام شملت العقوبات الأصلية والعقوبات التبعية، وتعدد العقوبات.
