ومن الجدير بالذكر أن الفقه قد أنقسم في شأن تحديدهِ للطبيعة القانونية للوكيل الإلكتروني إلى إتجاهينِ رئيسين؛ الأول يُقِرُ بوجود عقد وكالة بين المستخدم والوكيل الإلكتروني، في حين يُعِدهُ الإتجاه الآخر مجرد أداة إتصال بيد المستخدم.
