إن أهمية هذه الدراسة تظهر من خلال محاولة التعرّف على الإطار القانوني الدولي الذي يضمن حماية التنوع البيولوجي في العالم ومناقشة الإشكاليات المثارة حول العلاقة بين القانون الدولي والقانون الداخلي، ومدى إلزام القواعد الدولية بالنسبة للمشرّع الوطني.
كما تحاول الدراسة مناقشة مدى إلزامية معاهدة الأمم المتحدة للتنوع البيولوجي والإتفاقيات البيئية الأخرى للدول الأطراف في هذه الإتفاقيات، وكذلك الحال بالنسبة للدول غير المنضمة لهذه الإتفاقيات، وإلى أي مدى يمكن إعتبار هذه المعاهدة جزءاً من النظام الدولي العام وإعتبارها معاهدة شارعه، وخصوصاً أن الإتفاقيات الدولية التي قررها المجتمع الدولي لحماية النظام البيئي ومنها معاهدة التنوع البيولوجي جاءت كثيرة وغير متناسقة، الأمر الذي يستوجب توحيدها، إضافة إلى تفعيل آليات حماية البيئة في القانون الدولي.
