نظرا لأهمية موضوع الأقليات وحساسيته المفرطة فقد بدأ يحظى بأهمية خاصة لدى العديد من الباحثين والدارسين المتخصصين، خاصة بعد ظهور النماذج الديمقراطية المتعددة التي تبحث في أساس التوافق والسلم في المجتمعات المتعددة، الذي أساسه الإدارة الفردية للتسامح ومدى ارتباطها بالإرادة السياسية الجماعية على مستوى الدولة.
وهذه الدراسة المتواضعة جاءت في هذا الصدد لتبحث هذه المشكلة الجوهرية، التي لا تكاد تسلم منها دولة، خاصة وأنها تمس بأمنها واستقرارها وسيادتها، وبالذات عند وجود التدخل الخارجي لحماية هذه الأقليات، والإشكال الذي يمكن طرحه هنا هو: هل هناك حماية قانونية دولية للأقليات في ظل القانون الدولي المعاصر؟، ثم وفي حالة وجود حماية للأقليات في القانون الدولي، ففيما تتمثل مظاهر هذه الحماية؟
ومن أجل الإجابة عن ذلك فإنه من المهم التعرض لدراسة الوضع القانوني للأقليات في القانون الدولي وتحديد الحماية الدولية لحقوقها، وقد سعيت للبحث في موضوع الأقليات في العالم، والحماية القانونية لها في ظل القانون الدولي العام المعاصر، لكون هذا الموضوع حيوي وحساس للغاية ومهم خاصة في مثل هذه الظروف التي يعيشها العالم اليوم، واعتمدت المنهج التحليلي الوصفي في هذه الدراسة لكونه المناسب لها.
