لما كان موضوع هذا الكتاب هو بحث الظروف المشددة والمخففة فحسب، إلا أننا رأينا تمهيدًا واستكمالًا لهذا البحث أن نبدأ في عجالة ببيان الأصل أو بمعنى آخر الموضوع الذي ينتمي إليه هذا البحث- وهو- ما نطلق عليه ظروف الجريمة بصفة عامة- إذ لا شك أن هذا التعبير ينصرف إلى جميع تلك الظروف التي تقترن بالجريمة وبالمجرم من ظروف مشددة إلى ظروف مخففة إلى أعذار معفية وبصفة عامة إلى كل ظرف يمكن أن يؤثر على مقدار العقوبة تشديدًا أو تخفيفًا.
وبعد أن مهدنا لموضوع بحثنا بهذه العجالة بينا ماهية الظروف المشددة فيما يتعلق بجرائم الأموال ثم استعرضنا تلك الظروف المشددة فيما يتعلق بجرائم الأموال ثم استعرضنا تلك الظروف المشددة تقترن بجرائم الاعتداء على الأشخاص.
وقد رأينا أن نعرض لظرف الحرب- وهو ظرف مشدد- في مبحث خاص نظرًا لأهميته، وبه أنهينا بحث الظروف المشددة.
ثم استعرضنا بعد ذلك الظروف المخففة من حيث تاريخها وطبيعتها وأسبابها وأهم أحكام محكمة النقض في كل ما يتعلق بها.
وقد توخينا في هذا البحث أن يكون شاملًا جامعًا لكل دقائق وجزئيات الظروف المشددة والمخففة ظرفًا ظرفًا- كل ذلك في بيان سهل مذيل برأي الفقه وأحكام محكمتنا العليا.
ووفقًا لذلك جاءت خطة البحث مكونة من مقدمة وأربعة أقسام هي كالتالي: (القسم الأول: الظروف المشددة في جرائم الاعتداء على الأموال، القسم الثاني: الظروف المشددة في جرائم الاعتداء على الأشخاص، القسم الثالث: العود- ظرف الحرب، القسم الرابع: الظروف المخففة).
