كانت وما زالت مشكلة التلوث من كبرى الصعوبات التي تواجه العالم بأسره ولا تقتصر على مكان أو فئة معينة، وإزدادت هذه المشكلة في الوقت الحاضر إلى حد لا يمكن أن يرجى العلاج فيها حتى وقت قريب، لأن هذا الخطر يواجه الحياة بما يعدمها، فالتلوث أصبح اليوم وريث حل عن المجاعات والأوبئة، ولم تكن الدول متجاهلة لهذا بل ساهمت أكثرها بتوفير السبل اللازمة وكان من آثار هذا الإهتمام ما ورد في الإتفاقيات الدولية، منها إتفاقية لندن لسنة 1954 لمنع التلوث، وأخرى عام 1972، وثالثة عام 1973، وإتفاقية برشلونة لمنع التلوث لعام 1976، إلا أن هذه الإتفاقيات بقيت فيما حددت من قواعد المسؤولية عند حدود إرتكاب الخطأ وإثباته ضد المسؤول.
لهذا فإن المؤلف يبحث عن أساس جديد في ظل الربط بين مختلف القواعد بغية التوصل إلى حلول قانونية للمساهمة في مواجهة التطور الهائل الذي يحيط بالإنسانية في العالم المعاصر، ولغرض مسألة المنتج عن التلوث في إطار أوسع من الخطأ في المسؤولية الشخصية.
