لايجوز للائحة أن تخالف القانون أو الدستور ولا يجوز للقانون مخالفة الدستور ولهذا استنت الدساتير وسائل حماية هذا التدرج فى صورة المحكمة الدستورية العليا لمراقبة عدم خروج القانون عن الدستور وكذلك القضاء الإداري لمراقبة عدم خروج القرار الإداري الفردي أو اللائحة عن القانون وإذا كان مبدأ المشروعية يصلح للتطبيق في الدول الديمقراطية أو الدولة البوليسية بوصف أن القاضى عليه دائما مراعاة ألا يخرج القرار عن القانون أيا كانت ظروف وضع هذا القانون ومدى عدالته أو مخالفته لقواعد حقوق الإنسان, إلا أن حماية الحقوق والحريات لا تكون إلا فى نظام يضمن قدرا من الاستقلال للقضاء يتيح له فرصة فى ظل نظام يتمتع ببعض مظاهر النظام الديمقراطي كحرية الصحافة حتى ولو كان النظام فى باقى مظاهرة غير ديموقراطى تماما فهذا القدر من استقلال القضاء الإداري ووجود فصل إلى حد مابين السلطتين التشريعية والتنفيذية من ناحية والسلطة القضائية ووجود حرية للصحافة كاف ليباشر القاضى الإداري دوره في حماية الحقوق والحريات وهو ما يتحقق بالنسبة لمجلس الدولة المصري ومن هنا كان اجتهاد القاضى عظيما فى حماية الحقوق والحريات وحقوق الإنسان واستخدم سلطاته فى الخلق والإبداع لتطوير دعوى الإلغاء ليظلل من خلالها حمايته على الحقوق والحريات وهو ما يستوجب توضيح دوره فى هذا الخصوص.
