Book Description
إن أشرف العلوم وأعلاها وأَوْقَفَهَا وأَوْفَاهَا علم الفقه والفتوى، فبهِ صلاح الدنيا والعقبى، فلا علم بعد العلم بالله تعالى وصفاته أشرف من علم الفقه، وهو المسمى بعلم الحلال والحرام، وعلم الشرائع والأحكام، له بعث الرسل وأنزل الكتب؛ إذ لا سبيل إلى معرفته بالعقل المحض دون معونة الشرع، وقال الله تعالى: ﴿يُؤْتِي الْحِكْمَةَ مَنْ يَشَاءُ وَمَنْ يُؤْتَ الْحِكْمَةَ فَقَدْ أُوتِيَ خَيْراً كَثِيراً وَمَا يَذَّكَّرُ إِلَّا أُولُو الْأَلْبَابِ﴾... [سورة البقرة: آية 269]، حيث قيل في بعض وجوه التأويل: إن المراد بالحكمة: علم الفقه.
قال ابن وهب: قال لي مالك: وذكر قول الله عزّ وجلّ: ﴿ وَيُعَلِّمُهُ الْكِتَابَ وَالْحِكْمَةَ ﴾... [سورة آل عمران: آية 48]، وقوله: ﴿وَاذْكُرْنَ مَا يُتْلَى فِي بُيُوتِكُنَّ مِنْ آَيَاتِ اللَّهِ وَالْحِكْمَةِ﴾... [سورة الأحزاب: آية 34]، قال مالك: "الحكمة في هذا كله طاعة الله تعالى والإتباع لها، والفقه في دين الله تعالى والعمل به".
ولذا كان التَّفقه في دين الله عزّ وجلّ من أنفع المكاسب وأزكاها، لأن حوادث العباد مردودة إلى إستنباط خواطر العلماء ومداركهم، مربوطة بإصابة ضمائر الفقهاء، قال الله تعالى: ﴿وَلَوْ رَدُّوهُ إِلَى الرَّسُولِ وَإِلَى أُولِي الْأَمْرِ مِنْهُمْ لَعَلِمَهُ الَّذِينَ يَسْتَنْبِطُونَهُ مِنْهُمْ﴾...[سورة النساء: الآية 83].
ولما كان لهذا العلم تلكمُ الدرجة وهذه المنزلة أوْلاَهُ علماؤنا عناية كبيرة، وحرصوا على دراسته، وتدوين فروعه، ووضع القواعد والضوابط التي تجمع هذه الفُرُوع المتناثرة، وصنَّفُوا في ذلك كُتُباً كثيرة ما بين مُطوَّلة ومختصرة، ومن جملة المصنفات المختصرة والمفيدة التي كُتِبَ لها القبول والإنتشار بين عامة المهتمين بالفقه المالكي هذا المتن المعروف بــ "الْمُقدِّمَة العِزِّيَّة" التي صنَّفَهُا الإمام العلاَّمة فقيه المالكية: أبو الحسن علي بن محمد المُنُوفي الشاذلي، صاحب المصنفات والشُّرُوح المشهورة الذَّائِعة الصِّيت في المذهب، فقد رأى رحمه الله أن يضع مقدمة جامعة في فقه الإمام مالك لينتفع بها طلاب العلم وراغي التفقه سمَّاها: "الْمُقَدِّمَة العِزِّيَّة للجماعةِ الأزهرية"، وقد لخّصها رحمه الله من كتابه "عمدة السالك في مذهب الإمام مالك".
وقد جمع الْعَلاَّمَة المُنُوفي في مقدمته العِزِّيَّة أمهات مسائل الفقه من كتب المذهب ومصنفاته الكبار، وبيَّن فيها خلاصة ما انتهى إليه علماء المذهب من ترجيحاتٍ وتشهيراتٍ في المسائل التي وقع فيها الخلاف، حتى صارت هذه الْمُقَدِّمَة أصلاً مهماً من أصول المذهب التي جرى اعتمادها والتعويل عليها.
