إن موضوع الاستثمارات الأجنبية الخاصة وماتتعرض له من مخاطر غير تجارية في البلدان المضيفة لها يقودنا إلى البحث عن القواعد القانونية الدولية الخاصة بحماية الاستثمارات الأجنبية والمقررة بمقتضى أحكام العرف الدولي سواء الحماية الموضوعية أو الإجرائية ومدى كفايتها في توفير الحماية اللازمة لهذه الاستثمارات. كما أن موضوع الاستثمارات الأجنبية يدعونا إلى دراسة المعاهدات والاتفاقيات الجماعية التي عنيت بحماية وضمان الاستثمارات الأجنبية.
وفي محاولتنا للوصول إلى هذه الأهداف قمنا بتقسيم هذا البحث إلى فصل تمهيدي نتناول فيه تعريف الاستثمارات الأجنبية واشكالها القانونية والآثار الاقتصادية لها، ثم أعقبنا ذلك بدراسة الضمانات القانونية الدولية للاستثمارات الأجنبية في ثلاث فصول أساسية وذلك كالآتي: الفصل الأول: وفيه نتناول المخاطر غير التجارية التي تتعرض لها الاستثمارات الأجنبية الخاصة وأساليب حمايتها في القانون الدولي العرفي، الفصل الثاني: وسوف تخصص هذا الفصل لدراسة الاتفاقيات الجماعية الإقليمية والدولية الخاصة بضمان وحماية الاستثمارات الأجنبية الخاصة مع تحليل النصوص والأحكام القانونية التي احتوتها هذه الاتفاقيات، الفصل الثالث: وسوف نخصص هذا الفصل لدراسة اتفاقية البنك الدولي للإنشاء والتعمير والتي بموجبها تم إنشاء المركز الدولي لتسوية منازعات الاستثمار.
