جاءت هذه الدراسة بعنوان: (الحضانة في الفقه الإسلامي والقانون بالتطبيق على قانون الأسرة لدولة قطر).
الأسرة هي نواة المجتمع بأسره وأن ما يهدد تماسك الأسرة هو الطلاق فيقع الأطفال ضحية وفريسة سهلة للأخطار التي تهددهم.
إذن، إن صغر سن الطفل الذي لا يعرف شيء يسهل التحكم فيه في بداية حياته ولذا يجئ دور الحضانة كحافظة وراعية للأطفال من التمزق والتشرد وحماية حقوقهم من الضياع.
ومن هنا، تكمن أهمية الحضانة وإيجاد من هو أمين على الطفل بعد تشتت شمل الأسرة وتوفير الرعاية للطفل وبيان أهمية دور قضاء الأسرة في هذا الموضوع.
تناولت الدراسة تعريف الحضانة في الفقه والقانون وشروط والحضانة في الفقه الإسلامي وقانون الأسرة القطري، وكذلك ترتيب أصحاب الحق وفق آراء الفقهاء ومقارنتها بقانون الأسرة القطري، وتناولت آثار الحضانة المتمثلة في نفقة المحضون وسكناه وأجرة الحاضنة ومكان الحضانة.
وتوصل الباحث إلى أنه يجب إشراك علماء الإجتماع والباحثين والإختصاصيين الإجتماعيين بدراسة أوضاع الطفل المحضون وعلاقته بأبويه وأنه إذا كانت الطفولة متماسكة وقوية يكون كذلك المجتمع وإن كانت الحضانة مهلة يكون المجتمع عرضة للضياع والتشتت والفساد.
