يقصد بقانون الجزاء (مجموعة القواعد القانونية التي تحدد التصرفات والأفعال التي تعتبر جرائم، وبيان ما يترتب عليها من آثار جزائية مقررة لها)، أو بمفهوم آخر هو (ذلك القانون الذي يتضمن في ثناياه القواعد القانونية التي تبين الحد الفاصل بين ما هو مباح وما هو محظور في السلوك الإنساني والآثار الجزائية التي تترتب على مخالفتها أو الخروج عنها).
وبعبارة أدق هو (مجموعة القواعد القانونية التي تحدد الأفعال التي يعد إرتكابها جرائم بموجب نصوص قانون العقوبات، ويحدد أيضاً الجزاء الجنائي المترتب على إرتكابها سواء تَمثَّل ذلك في صورة عقوبة أو في صورة تدابير وقائية، مع إشتماله على القواعد الأساسية والمبادئ العامة التي تحكم هذه الجرائم والعقوبات والتدابير).
وإنطلاقاً مما سبق، فإننا نجد أن قانون الجزاء يشتمل على نوعين من الأحكام الموضوعية، الأولى تتمثل في الأحكام العامة التي تبين القواعد والنظريات العامة التي تحكم التجريم والعقاب وتسري على كل الجرائم والعقوبات - أو أغلبها - والثانية تتمثل في أحكام خاصة وتشتمل على بيان الجرائم بمفرداتها وأركان كل منها، والظروف الخاصة بها، والعقوبة المقررة لها، وهو ما يطلق عليه القسم الخاص من قانون العقوبات، في حين أن النوع الأول من هذه الأحكام هو ما يعرف بالقسم العام لقانون العقوبات.
