الشروع في ارتكاب الجريمة يعني إخفاق الجاني في تحقق غايته الإجرامية كما هو عازم عليها، وكما هي متصورة في نيته ومرسومة في نموذجها بقاعدتها التجريمة، لأسباب ليس مرجعها إرادته، سواء أكان الإخفاق بعد أستنفاذ السلوك الجرمي أم بسبب إيقاف ذلك السلوك. وعلى هذا فإن الشروع على الرغم من تخلف النتيجة الإجرامية فيه إلا غنه ينبؤنا عن خطورة إجرامية تهدد المصلحة محل الحماية الجنائية، وبالتالي من شأنها أن تؤثر في أمن المجتمع وحقوق الأفراد، وسلوك الجاني على هذا قد يستحق العقاب، ولكن ما هو الشروع على وجه الدقة القانونيةظن التي تخول للقاضي أن يصدر حكما هو عنوان الحقيقة والعدالة معا، وما هي صوره وماذا عن أركانه، وهل يعاقب على الشروع في كل الحالات، أم أن هناك فرصة لذلك الفاعل.
ولأن المسألة تثير كثيرا من التفصيلات، ومازالت تبحث عن غجابات، ولذا قسمنا خطة البحث إلى مقدمة ومطلبين بكل مطلب فرعين محاولين جمع الشارد والوارد ذلك الموضوع الحيوي والشائك، مع بيان موقف المشرع المصري وكذا موقف المشرع في بعض الدول العربية، بشكل موجز غير مخل مدعوم بأحكام القضاء العالي والنقض والتمييز. وقد أتت خطة البحث وفق الأتي: المقدمة والمطلب الأول في ماهية الشروع في إرتكاب الجرائم، المطلب الثاني/ أركان الشروع وعقوبته.
