يدور موضوع الكتاب حول جريمة هزت مشاعر المجتمعين اللبناني والعربي والمجتمع الدولي بأسره، وهي اغتيال الرئيس الشهيد رفيق الحريري ورفاقه في لبنان والتي أصبحت قضية دولية لما لشخص الرئيس الشهيد من ثقل على الساحتين العربية والدولية. فكان لاغتياله أثر هام على الأمن والسلم الدوليين، وكذلك الوحدة الوطنية في لبنان.
وفي هذا الكتاب يتطرق المحامي "هيثم محمد فخر الدين" إلى قضية اغتيال الرئيس الشهيد من حيث دخول هذه القضية باب المحكمة الجنائية الدولية الدائمة وخصوصاً أن نظامها الأساسي لا تمييز فيه لأي صفة رسمية للشخص "سواء كان رئيساً لدولة أو حكومة أو عضواً في حكومة أو برلمان أو ممثلاً منتخباً أو موظفاً حكومياً، لا تعفيه بأي حال من الأحوال من المسؤولية الجنائية بموجب هذا النظام الأساسي، كما أنها لا تشكل، في حد ذاتها، سبباً لتخفيف العقوبة ...".
وعلى هذا يتضمن هذا البحث محاولة الإجابة عن إمكانية إجراء محاكمة المسؤولين عن جريمة اغتيال الرئيس الحريري ورفاقه أمام المحكمة الجنائية الدولية الدائمة وذلك ضمن قسمين: القسم الأول: يدور حول إمكانية اعتبار هذه الجريمة من ضمن الجرائم التي تنظر بها المحكمة الجنائية الدولية الدائمة، والقسم الثاني: يدور حول الآلية القانونية لإحالة هذه الجريمة أمام المحكمة الجنائية الدولية الدائمة.
