في هذا الكتاب دراسةٌ علميةٌ مُعَمَّقَةٌ موثَّقَةٌ لقضية فقهية حيوية بالغةِ الأهميةِ في معاملات الناس المالية اخلفَتْ فيها الأفهامُ، وتباينَتْ في أحكامها الإجتهادات الفقهيةُ السالفة، واضطربت في مضائقها أنظارُ العلماء ومذاهبُ الفقهاء المتقدمين والمتأخرين، ولم تَحْظَ ببحث علميٍّ جادِّ مستوعِبٍ، يلُمُّ شعثها، ويُحَرِّرُ أحكامها، ويضبطُ معاقدها، ويكشف ما فيها من مشاكلات، ويُخَلِّصُ جوهرها من شوائب الملابسات، ويحلُّ ما فيها من عُقَدٍ ومشكلات، ويَفْصِلُ ما وقع فيها من نزاعات.
وقد تجلَّتْ حاجةُ الناس الماسَّةُ في عصرنا الحاضر إلى التعامل بنماذجَ متعددةٍ وصنوفٍ متنوعةٍ من صورها وفروعها في شؤونهم التجارية والصناعية والزراعية، واقتضَتْ مصالحهم إستحداثَ أشكالٍ جديدة وألوانٍ فريدةٍ من مسائلها وتطبيقاتها في أسواقهم ومعاقداتهم ونشاطاتهم الإقتصادية المختلفة... فإتجه الخاطر إلى صياغة بحثٍ جامعٍ لمسائلها، فاتحٍ لمغلقاتها، محرِّرٍ لأحكامها، عارضٍ لمقولات أهل العلم فيها، مع بذلِ الوسع وإستفراغٍ الجهد في تحليلها، ومناقشةِ أدلتها وتفصيلاتها، والترجيح بينها، في ضوءِ النصوص الشرعية، وهَدْي القواعد الأصولية والفقهية.
وقد اقتضَتْ طبيعةُ البحث تقسيمَه إلى تمهيد وثلاثة مباحث وخاتمة: فجعل التمهيد مختصاً ببيانِ حقيقةِ الإجارة في الإصطلاح الفقهي، وإطلاقها بالمعنى العام والخاص، وأقسامها بالنظر إلى نوع المنفعة المعقود عليها، وبالنظر إلى محلِّ تعلُّقِ الحقِّ فيها، وأفرد المبحث الأول لتأصيلِ حكمِ تحديد الأجرة في عقود الإجارة المحضة، وما يترتَّبُ عليه من كيفية تحديدها، أما المبحث الثاني، فقد عرض فيه بالشرح والتفصيل كيفيةَ تحديد الأجرة في عقود الإجارةِ المُشَاكِلَةِ للشركة والجعالة، وأما المبحث الثالث، فقد اختصَّ بمسائل وصورِ وأشكالِ وتطبيقاتِ مبادئ وضوابطِ تحديد الأجرة في عقود الإجارة المستحدثَة، سواءٌ كانت إجارةَ أشخاص أو إجارةَ أعيان مالية، ثم جاءت الخاتمةُ بعرضٍ وجيزٍ لأهم النتائج التي توصل إليها في ثنايا هذه الدراسة.
