تضمن الدستور الجديد العديد من الاتجاهات الحديثة في الفقه الدستوري فمن ناحية أولى حظر الجمع بين السلطات، مما يعني أفول نظرية الحاكم المطلق التي نهجها دستور 1971 في المادة 74 منه، ومن ناحية ثانية أخذ الدستور الجديد بالنظام المختلط، وبمبدأ ثنائية السلطة، ومن ناحية ثالثة فقد نص الدستور الجديد على العديد من المبادئ المستحدثة، سواء في وثيقة الدستور كمبدأ مساهمة الشعب في صنع القرارات الوطنية ومبدأ التداول السلمي للسلطة والذي أعاد النص عليه بنصوص مستقلة، ام في بعض نصوصه، كمبدأ السيادة ومبدأ الشورى، أم جعل لها باباً مستقلاً، كما هو الحال في الباب الخامس الخاص بالهيئات المستقلة والأجهزة الرقابية.
ويلاحظ أن بعض النصوص مستحدثة، والبعض الأخر كان منصوصاً عليها في قوانين مستقلة، كقانون الطفل رقم 12 لسنة 1996، والقانون رقم 103 لسنة 1961 بشأن إعادة تنظيم الأزهر والهيئات التي يشملها، وقانون السلطة القضائية، وعلى هذا، يتناول البحث المبادئ المستحدثة في الدستوري الجديد في خمسة أبواب؛ طبقاً لتناول الدستور لهذه المواد (الباب الأولك مقومات الدولة والمجتمع، الباب الثاني: الحقوق والحريات، الباب الثالث: السلطات العامة، الباب الرابع: الهيئات المستقلة والجهزة الرقابية، الباب الخامس: أحكام ختامية وانتقالية).
