تستمد أهمية البحث في هذا الموضوع من أن عقود الفيديك النموذجية أو ما يُعرف بعقود الإنشاءات الدولية هي الأكثر استعمالاً عند صياغة عقود الإنشاءات والمقاولات التي يتم في غالبية الدول ؛ وخصوصاً في المشروعات التي يكون المقاول الأصلي فيها إحدى شركات المقاولات دولية النشاط ، وعلى نحو أخص في المشروعات التي يتم تمويلها تمويلاً كلياً أو جزئياً من جهات تمويلية مانحة أو مقرضة دولية أو ذات نشاط دولي ؛ حيث تشترط هذه الجهات التمويلية أن يتم إبرام العقد على نسق عقود الفيديك النموذجية وفي مقدمتها كتاب الفيديك الأحمر .
وبالتالي يُعد موضوع حل النزاعات الناشئة عن عقد الفيديك من أهم الموضوعات التي تتعلق بهذا العقد النموذجي ، ويبلغ في أهميته درجة تعادل الأهمية التي توازي موضوع هذه العقود المتمثلة في المشروعات الإنشائية .
