تحاول هذه الدراسة تقييم تجربة السلطة المحلية في اليمن من منظور قانوني، ويُعنى نظام السلطة المحلية بتوفير الآليات التي من شأنها تمكين الهيئات المحلية - بغض النظر عن أسلوب تشكيلها - من إدارة شؤون المجتمع المحلي بما يتيح لها توفير احتياجاته ومتطلباته، وتكمن القيمة الحقيقة لآليات نظام الإدارة المحلية في توزيع الاختصاصات الإدارية بين الأجهزة المركزية في الدولة والهيئات المحلية، ويترتب على ذلك تخفيف الأعباء عن كاهل السلطة المركزية خصوصاً مع اتساع نشاطها الإداري بسبب تدخلها في المجالات الاقتصادية والاجتماعية، وهو ما يتطلب وجود أعداد كبيرة من الموظفين والعاملين للاضطلاع بالوظائف المختلفة على امتداد إقليم الدولة، ولا يجدي مع هذا التوسع تركيز السلطات في أيدي الأجهزة المركزية في العاصمة، فكانت اللامركزية الإدارية التي تمثل الإدارة المحلية جوهرها هي الحل لمشكلة اتساع أنشطة الدولة الحديثة. ونظام الإدارة المحلية ليس نظاماً حديثاً مرتبطاً بالدولة الحديثة، بل هو نظام قديم قدم البشرية ذاتها، ارتبط بوجود الإنسان في صور وأشكال متعددة تختلف عما هو عليه الآن من تطور، ومع ذلك تختلف تطبيقات نظام الإدارة المحلية من بلد لآخر شكلاً ومضموناً، ضيقاً واتساعاً، ومرد ذلك الاختلاف مدى تبني الدول للمبادئ الديمقراطية أو ابتعادها عنها. وبانتهاج الجمهورية اليمنية للديمقراطية منذ عام 1990 عقب إعادة تحقيق الوحدة المباركة، كانت الإدارة المحلية مظهراً بارزاً من مظاهر التجربة الديمقراطية الوليدة، ولكونها كذلك، فإنها رغم إيجابياتها المتعددة إلا أنها لم تسلم من السلبيات، وذلك أمر وارد في أغلب التجارب، غير أن الأمر المهم ألا يتسع نطاق الجوانب السلبية على حساب الجوانب الايجابية. ومما لا شك فيه أن التقييم المستمر لهذه التجربة سيحد من تراكم السلبيات من خلال الدراسات والندوات والمؤتمرات وورش العمل التي تناقش تطبيقات الإدارة المحلية بمختلف مستوياتها بهدف تطويرها وإثرائها، والعمل على تكريس وترسيخ الجوانب الايجابية، ومعالجة الجوانب السلبية.
