حيث أن الاعتداء على الحيازة بصفة عامة بعيدًا عن كون الحائز مالكًا للحق العتدي عليه أو كونه حائز فقط، وهذا الاعتداء يعكر صفوه كحائزًا، ويمنعه من استعمال حيازته أو الانتفاع بها، ومما جعل المشرع يتدخل لحمايته من مجرد الاحتمال إلى التعرض الفعلي وحتى بلوغ هذا التعرض على أقصى حدوده، وذلك بسلب الحيازة، ولما كانت لدعوى منع التعرض من الأهمية العملية بمكان، وحتى تسقيم يجب أن تتوافر لها عدة مقومات وشروط.
فكان هذا الكتاب الثاني من السلسلة التي بدأناها (الحماية المدنية والجنائية للحيازة). على أن يتضمن هذا الكتاب: تعريف الحيازة وخصائصها وكيفية زوالها. تعريف دعوى منع التعرض وشروطها، والخصوم فيها والمحكمة المختصة بنظرهما وموقعها من القضاء المستعجل والحكم فيها وحجيته، نموذج لصيغة دعوى منع تعرض.
