إن مؤلَّف الأستاذ موفق ميرزي الجديد يأتي لسد نقص حاد في قانون الإيجار الأخير الذي عوضاً عن أَن يأتي بحلول لما يعانيه المواطن اللبناني المستأجر أصبح يؤلف مشكلة له غير قابلة للحل بل خلق مشاكل مستعصية على كل حل.
وأكثر من ذلك، فإن ما زاد في الطين بله أَن القانون المذكور لم تأت ولادته طبيعية، وقد استغرق التحضير له ربع قرن، ومن ثم أُبطل لأول مرة لأمور شكلية، ومن ثم أُبطل ثانية في بعض مواده من المجلس الدستوري بحيث أصبح القانون في الواقع، قانونان، والآراء متعددة بشأن كل ما ورد فيه، بل إنها متناقضة فيما بينها؛ إلى درجة أنه وبعد إعادة نشر للمرة الثانية، انقسم العاملون في القضاء إلى أكثر من فريق، وكل فريق مناهض للفريق الآخر، وبعضهم رفض تطبيقه، والبعض الآخر تريث في التطبيق والبعض الثالث بادر إلى تطبيقه بالفعل، في حين أَن البعض الرابع اعتبر أن القانون رقم 160/ 92 السابق ما يزال قائماً في بعض مواده وفي روحيته، لا سيما وإن القانون تاريخ 8/ 5/ 2014 أتى بحلول وصفها البعض بأنها غير منطقية، مثال ذلك، أَن النسيب الشاغل مع المستأجر الأساسي يستفيد من التمديد القانوني إذا ترك هذا الأخير المأجور، أو توفاه الله تعالى، في حين أن ابن المستأجر الأصلي الشاغل مثله يسد أمامه باب الإستفادة من التمديد القانوني مع إتحاد العلة.
ولهذا، كان ينبغي التبصر مسبقاً إلى هذا الحل الذي لا يقبله المنطق العادي، والأمثلة الأخيرة هي كثيرة في هذا القانون الجديد.
