تهدف الدولة إلى الحفاظ على أموالها العامة سواء كانت العقارية منها أو المنقولة، لرغبتها في الحفاظ على ثروتها القومية من كل عبث يحدث من جراء التعدي عليها، ونظرًا لتركز الدراسات على جرائم الأموال العامة التي تقع على المال المنقول اتجهنا صوب تلك الدراسة والتي لن تقتصر على حماية أملاك الدولة العقارية التي تطبع بكونها أموالًا عامة، بل ستمتد لتشكل بعض العقارات المملوكة للدولة ملكية خاصة كالأراضي الصحراوية، وكذلك بعض العقارات ذات الأهمية لدى الأفراد، كأماكن العبادة ولو لم يكن البعض منها يوصف بكونها أموالًا عامة.
وسوف نتناول مفهوم المال في فصل تمهيدي يليه ثلاثة أبواب، الباب الأول نتناول الحماية الجنائية للعقارات ذات الطابع العسكري والديني ومدى هذه الحماية فيما يعرف بالجريمة المنظمة، وذلك سواء في قانون العقوبات أو قانون القضاء العسكري، والباب الثاني نتناول فيه الحماية الجنائية للأموال العقارية للدولة في نطاق الجرائم المرتكبة من الموظفين العموميين والأفراد، والباب الثالث نتناول فيه الحماية الجنائية للملكية العقارية للدولة في نطاق التشريعات الجنائية الخاصة، ونخص منها حماية العقارات الأثرية، والأراضي الصحراوية وحماية العقارات المعدة كلجان انتخابية، وذلك في نطاق قانون مباشرة الحقوق السياسية وقانون انتخاب رئيس الجمهورية، ثم نختم الدراسة بعرض ملخص لما انتهت إليه الرسالة.
