إن حقوق الملكية الفكرية تشكل أسمى الحقوق، وذلك لأنها تتعلق بأسمى ما يملكه الإنسان وهو العقل الذي يبدع ويبتكر ويفكر. ولما لهذا الحق من أهمية عظمى فقد عنيت التشريعات الدولية بتنظيمه باتفاقيات دولية عديدة بداية من اتفاقية باريس لحماية الملكية الصناعية (سنة 1883). وقد صدر قانون حماية حق المؤلف رقم 354 سنة 1954 واتضح هذا الإدراك خاصة بعد الانضمام لمنظمة التجارة العالمية ولم يقصر الحماية على الحقوق التقليدية لحق المؤلف والعلامات التجارية وبراءات الاختراع والرسوم والنماذج الصناعية بل امتد ليشمل مجالات جديدة تتمثل في الحقوق المجاورة لحق المؤلف والمؤشرات الجغرافية والتصميمات التخطيطية للدوائر المتكاملة والمعلومات غير المفصح عنها والأصناف النباتية نظرًا لما لحق هذه المجالات من تطور كبير يتعين أن يبسط عليها يد الحماية الدولية والوطنية فأصدر المشرع قانون حماية حقوق الملكية الفكرية رقم 82 لسنة 2002، وهو موضوع هذا المؤلف.
