إن مجال هذه الدراسة المقارنة لأركان الاتفاق على التحكيم، وشروط صحته سوف يقتصر على اتفاقات التحكيم الوطنية البحتية والخاضعة للسيادة التشريعية للقانون الوطني "المصري، أو الفرنسي المقارن". بمعنى، العلاقات الداخلية التي اتفق على إخضاعها لقواعد التحكيم داخل الدولة، بالتطبيق لقواعد الإجراءات الوطنية، أي العلاقات الوطنية البحتة بمختلف عناصرها، سواء من حيث أشخاص العلاقة ومحلها، وسببها. والتي مؤداها، التجاء أطراف وطنية إلى تحكيم يتم داخل الدولة، وبالتطبيق لأحكام القانون الوطني، ويسفر عن صدور حكم تحكيم يكون محلًا للتنفيذ وفقًا لقواعد قانون المرافعات المدنية، والتجارية، أو قواعد أحكام القوانين الوضعية الخاصة المنظمة للتحكيم- كالقانون الوضعي المصري رقم (27) لسنة 1994 في شأن التحكيم في المواد المدنية والتجارية.
ومن ثم، فإنه يخرج عن مجال هذه الدراسة، التحكيم الدولي واتفاقات التحكيم التي لا تكون خاضعة للسيادة التشريعية للقانون الوطني "المصري، أو الفرنسي المقارن"، أي اتفاقات التحكيم التي لا تكون وطنية بكافة عناصرها.
تقسيم الدراسة: لقد سلكنا في هذه الدراسة مسلكًا يتفق وتحقيق الغاية المرجوة منها، فقد قسمتها إلى ثلاثة أبواب، وذلك على النحو التالي: الباب الأول: التعريف بنظام التحكيم، وبيان عناصره. الباب الثاني: أنواع نظام التحكيم. والباب الثالث: تمييز نظام التحكيم عن الصلح، الوكالة، والخبرة. وإلى تفصيل كل هذه المسائل.
