عندما تكتب باحثة قانونية عن ضمانات حقوق إجرائية للمرأة المصرية، فإنها لا بد وأن تقدم بحثًا جديرًا للاهتمام، فإذا كانت الباحثة أستاذة جامعية فلا بد أن يتصف البحث بالجدة والجدية.
وقد حرصت الدكتورة: سحر عبد الستار- في شرحها لتلك الحقوق- على الدفاع عن مبدأ يخالف المبدأ العام. فالأصل هو مساواة الجميع في الحقوق والواجبات، وكانت الحركة النسائية تنادي دائمًا بالمساواة القانونية بين المرأ والرجل. ولكن الباحثة وجدت أن هذه المساواة لا تحفظ حقوق المرأة، فنادت بمبدأ عدم المساواة القانونية بينهما، ورأت أنه هو وحده الذي يحقق المساواة الفعلية بين المرأة والرجل.
وفي سبيل الدفاع عن مبدأ عدم المساواة القانونية، عرضت الباحثة للنصوص التشريعية في القانون المصري المتعلقة بالتقاضي وبالتنفيذ الجبري للأحكام والتي تنطوي على استثناءات من القواعد الإجرائية العامة.
وقد عنيت الباحثة بشرح تلك القواعد الخاصة شرحًا مبسطًا ومتعمقًا مستعينة بالفقه وأحكام القضاء. فأوضحت القاعدة الخاصة بالاختصاص في دعاوى النفقة، والاختصاص بشأن المنع من السفر، والولاية التعليمية، وعرضت لما يتعلق بالإعفاء من الرسوم القضائية بالنسبة لدعاوى النفقة، ولإجراءات دعوى الخلع وشروط الحكم به، وتناولت النفاذ المعجل لأحكام النفقة، والقواعد الخاصة بتنفيذها جبرًا.
ولهذا فإن هذا البحث سوف يكون مرجعًا مفيدًا للقاضي والمحامي، وعونًا للمرأة في المطالبة بحقوقها. وسيحتل المكانة التي يستحقها في المكتبة القانونية العربية.
