وأمام تعدد الإشكالات التي تطرحها عملية توزيع أرباح الشركات التجارية، فقد إرتأينا تقسيم دراستنا إلى جزئين، ندرس في أولهما الوجه التعاوني للمسألة، أن قواعد السير العادي لعملية التوزيع، أما الجزء الثاني فسنخصصه للوجه التنازعي لذات المسألة، مع التركيز على دور القاضي في هذا الميدان.
