تباين موقف الدساتير العربية من تنظيم مسؤولية رئيس الدولة، بين من نأى بالرئيس عن المسؤولية عملاً بمبدأ (الرئيس مصون وغير مسؤول)، كالدستور الإماراتي والتونسي والأردني والبحريني والقطري، وبين من نص على مسؤولية الرئيس على نحو بدا فيه الرئيس واقعاً مصون وغير مسؤول، فالدستور السورى مثلاً يشترط لمساءلة الرئيس توجيه الاتهام إليه من قبل كل أعضاء مجلس الشعب فى الأقل (م 91) وهو أمر أقرب للاستحالة منه للتحقق فلا يمكن تصور إجماع كل أعضاء السلطة التشريعية على مسألة واحدة ولاسيما فى ظل نظام الحزب الواحد، الذى يهيمن تلقائياً على كل مؤسسات الدولة ومفاصلها.
ومثلما تتباين موقف الدساتير العربية في مساءلة الرئيس، تتباين موقفها في النص عن مسؤولية الرئيس عن الجرائم التي يمكن مساءلته عليها، فهناك من ضيق نطاق مسؤوليته فى مسائلته عن جريمة الخيانة العظمي فقط كالدستور السوري والجيبوتي والموريتاني وجزر القمر وبين من وسع من نطاق مسؤوليه الرئيس قياساً للصلاحيات المحددة التى نأطها به الدستور، كالدستور العراقى لسنة 205، الذى ساءل الرئيس عن جريمه الخيانه العظمى والحنث باليمين وانتهاك الدستور وعدم الكفاءة والنزاهة . فى الوقت الذى يتمتع فيه الرئيس فى ظل الدستور المذكور إلا بصلاحيات دستورية محددة. وعلى ضوء هذا يناقش هذا الكتاب مسألة تناسب صلاحيات الرئيس الدستورية مع سلطاته الممنوحة فى ظل الدساتير العربية القائمة.
