إن الدستور هو أساس الحياة القانونية للدولة، فلا يتخيل وجود دولة حديثة من دون دستور ينظم شؤون الحكم وقواعده وأعماله وأنشطته وأجهزته المختلفة، فإن خلت الدولة من الدستور عمت الفوضى والفساد وعدم الإستقرار، لذلك للدستور مكانة عليا في كل الدول، وهذه المكانة تأتي من كون الدستور يحدد الإطار العام لنظام الحكم، فهو يبين سلطاته وإختصاصات كلا منها.
والدساتير في العالم تصنف إلى دساتير مرنة، ودساتير جامدة، فالدساتير المرنة هي الي يتم تعديلها بواسطة السلطة التشريعية في الدولة، وتعدل بالطريقة المتبعة في تعديل القوانين العادية دون الحاجة إلى إجراءات خاصة ومعقدة، أما الدساتير الجامدة فلا يمكن تعديلها بطريقة وإجراءات تعديل القوانين العادية، وإنما بحاجة إلى إجراءات خاصة ومعقدة تختلف عن إجراءات تعديل القوانين العادية.
وإن صفة الجمود في الدساتير تؤثر بشكل مباشر وغير مباشر في إستقرار النظام السياسي، وكذلك في إستقرار شكل الدولة وهويتها الرسمية وعلى ثبات المؤسسات الدستورية فيها، والحفاظ على مبدأ الفصل أو دمج السلطات، وكذلك في ضمان وإحترام الحقوق والحريات الواردة في الدستور، بحيث لا تتأثر بالمزاج الجماهيري ولا بإندفاعات البرلمانات المؤقتة والعابرة.
