يحكم موضوع القتل بدافع الشفقة التمييز بين فكرتين أساسيتين الفكرة الأولى هى أن يكون القتل بناءا على طلب المريض صراحة أو ضمنا بإنهاء حياته، والفكرة الثانية هى أن يكون القتل بدافع الشفقة بناءا على طلب الغير، والتعمق فى الفكرة الأولى والمتصلة فى جانب منها بكون القتل قد تم بناءا على طلب المريض الصريح تتطلب عرض مدى توافر الرضاء الصحيح من جانب المريض ومحاولة البحث تأصيل قانون لتبرير القتل بدافع الشفقة، ثم التركيز على باعث الشفقة لدى مرتكب الفعل ومدى تأثيره فى المسئولية وفى جانب آخر من ذات الفكرة فى حالة الرضاء الضمنى من جانب المريض بالقتل اشفاقا يتطلب الأمر تحليل معنى رفض المريض الخضوع للعلاج حتى الموت أو تحليل كيفية تنفيذ فعل إنهاء الحياة سواء كان التدخل ايجابيا أم سليا عن طريق الطبيب أو متطوع من الغير، ثم تحليل وجهة نظر التشريعات الهولندية والأمريكية من حيث محتوى طلب القتل اشفاقا وإجراءاته.
أما تحليل الفكرة الثانية والمتعلقة بكون القتل بدافع الشفقة قد تم بناءا على طلب الغير (وليس بناءا على الطلب الصريح للمريض) يقتضى الدقة فى تعريف المقصود بالغير، فقد يكون هذا الغير إما وكيلا عن المريض وقد يكون محرضا للمريض، فإذا كان وكيلا كما لو كان المريض فى حالة غيبوية هل يحل رضاء الغير محل رضائه؟ وإذا كان محرضا للمريض على طلب الموت فكيف تحدد مسئوليته.
وعلى ذلك نرى تقسيم خطة البحث لمحاولة تحليل كافة أبعاده على النحو التالى: (الباب الأول: القتل بدافع الشفقة بناءاً على طلب المريض، الباب الثانى: القتل بدافع الشفقة بناءاً على طلب الغير).
