إن هذا المؤلف "بداية المجتهد ونهاية المقتصد" هو من المؤلفات الفقهية التي يشار إليها بالبنان وهو لابن رشد القرطبي الحفيد الذي ملأ الأرض علماً بمؤلفاته وتصنيفاته. وهذا الكتاب يدخل في علم الخلاف، وهو فرع عن علم الفقه الإسلامي، وقد برز علم الخلاف، وهو ما يسمى في عصرنا الراهن باسم الفقه المقارن، بعد نضوج المذاهب الفقهية وثباتها واستقرارها.
وهو علم يتعلق بالأدلة والأصول التي يأخذ منها الأئمة أحكامهم، ويبحث عن وجوه الاستنباط من الأدلة الإجمالية والتفصيلية ويقيم الأدلة والبراهين والحجج الشرعية لاجتهاد الأئمة الفقهاء. ومن خلال تبيان وإيضاح علم الخلاف يتجلى لنا عمل الفقيه ابن رشد في كتابه بداية المجتهد الذي بيّن فيه قبل كل شيء نقاط الاتفاق ومن ثم نقاط الاختلاف في البحث الفقهي وذلك حتى يحرر محل النزاع، ثم يسرد المؤلف أقوال الفقهاء سواء أصحاب المذاهب الأربعة أو غيرهم من الفقهاء وذلك في المسألة الشرعية المختلف فيها، ويبين سبب اختلاف الفقهاء حتى يتسنى للقارئ معرفة التعليل أو الدليل الذي اعتمده الفقيه في استنباطه للأحكام الشرعية.
وتعتبر طريقة ابن رشد التي اتبعها في كتابه منهجية وموضوعية لأنه يبدأ بذكر الباب وبذكر الخطة التي سيسير عليها والمسائل التي يقوم بدراستها ثم يذكر الأدلة الشرعية للباب أو المسألة إن وجدت.
وكلّ هذا العمل كان بأسلوب مختصر وغير مخلّ ومرتب ترتيباً فقهياً على أبواب الفقه المعهودة، ومما يجدر الإشارة إليه أن هذا المؤلف يعتبر أيضاً من الكتب التي تتكمل عن المسائل الفقهية الأصلية ويهمل الفروع الفقهية الكثيرة والتي تحتاج إلى مجلدات. ويعتبر كتاب بداية المجتهد، مع صغر حجمه، من أهم الكتب في الفقه المقارن. ومما يدل على أهمية هذا الكتاب أنه متداول في أروقة العلم والمؤسسات العلمية، وبين أيدي الطلاب والباحثين.
