هذا الكتاب هو أطروحة الدكتوراه للمؤلف. إنه يعالج مسألة دستورية مطروحة باستمرار في الدول الديمقراطية موضوعها: "حق رئيس الدولة بنقض القوانين" وردها إلى البرلمان لإعادة النظر بها. هذا الحق الذي يمنحه الدستور لرئيس الدولة ينبثق تاريخياً وأساساً من "حق الملك في التصديق على القوانين أو رفض التصديق". (Droit de sanction royaie ou de refus de sanction).
هذا الحق الملكي مورس في بادئ الأمر في إنكلترا ومن ثم في باقي الأنظمة الملكية، وكان بالأساس حقاً مطلقاً تحول إلى حق مرن وهو لا يزال قائماً نظرياً أو عملياً في بعض الأنظمة الملكية المعاصرة وقد ألغي عملياً أو دستورياً في البعض الآخر، وقد تحول هذا الحق في الأنظمة الجمهورية الحديثة (على أنواعها) إلى "حق نقض معلق" للقوانين (Veto suspensif) أو إلى "حق طلب إعادة النظر بالقوانين" (Nouvelle d'eliberation des lois) يمنحه الدستور صراحة لرئيس الدولة.
إن حق نقض القوانين أو طلب إعادة النظر بها يمارس في عصرنا بدرجات متفاوتة من الصلابة أو المرونة تختلف من دولة إلى أخرى. كما أنه يمكن أن يطال -في بعض الدول- كل أنواع القوانين، وفي دول أخرى بعض القوانين. لكن هناك قوانين -نظراً لطبيعتها ولمصدرها- معفية من ممارسة حق النقض عليها أو طلب إعادة النظر بها مثل القوانين الشعبية والقوانين الاستفتائية... الخ.
هذا الكتاب يعالج هذه المواضيع بصورة مقارنة وبشكل مسهب في 98 دولة مع التوقف بصورة خاصة عند حق ممارسة حق النقض وطلب إعادة النظر بالقوانين في لبنان والدول العربية وفرنسا والولايات المتحدة الأميركية.
