يجب دائمًا أن تكون المقدمات التي جعلها القاضي الأساس لحكمه سواء أكان ذلك من حيث الواقع أم من حيث القانون، مؤدية وفق قواعد العقل والمنطق إلى النتيجة التي انتهى إليها، بحيث يتحقق التلازم والاتساق والوحدة المنطقية بين هذه المقدمات وتلك النتيجة. واتباعًا للقواعد المنطقية أيضًا فإنه يتعين على القاضي أن يبذل نشاطًا ذهنيًا منطقيًا لكي يصل إلى التكييف القانوني الصحيح للواقعة المعروضة عليه.
فإن القواعد المنطقية تعد أهم الأدوات التي تمكن القاضي من الوصول في الدعوى المعروضة عليه إلى الحكم الصحيح الذي يتطابق مع الواقع ويتفق مع القانون ويقترب قدر المستطاع من الحقيقة الواقعية. وإذا كان الحكم القضائي يتكون من أجزاء ثلاثة هي الديباجة، والأسباب والمنطوق، فإن أهم هذه الأجزاء هي الأسباب لأنها ترجمان اقتناع القاضي وإظهار مدى فهمه للواقعة والأدلة، القائمة في أوراق الدعوى، ومدى سلامة تطبيقه للقانون عليها.
واتساقًا مع ذلك فإننا سنقسم هذه الدراسة إلى فصلين، نفرد الأول لاستخدام القاضي لقواعد علم المنطق لفهم الواقع في الدعوى المعروضة عليه، ونخصص الثاني لاستخدامه هذه القواعد لفهم القانون الواجب التطبيق على هذا الواقع في فهم القانون الواجب التطبيق عليها.
