يعتبر موضوع العلامات والبيانات التجارية واحد من أهم وأكثر الأمور التي يتعامل معها الإنسان في حياته اليومية. وقد اهتم المشرع بهذا الشأن وأفرد لموضوع العلامات والبيانات التجارية المواد من 63 إلى 113 من القانون رقم 82 لسنة 2002 بشأن حماية الملكية الفكرية, وللحقيقة فإن هذا القانون يعد أحد نتائج انضمام مصر لاتفاقية الجوانب المتصلة بالتجارة من حقوق الملكية الفكرية, أو ما تعرف اختصارًا باسم التريبس "TRIPS".
لنا فقد قدمنا هذه الدراسة, وحاولنا فيها أن نبين الجوانب التاريخية التي أدت إلى إبرام اتفاقية الجوانب المتصلة بالتجارة من حقوق الملكية الفكرية "التريبس" وأهم ملامح تلك الاتفاقية, وما هو المقصود بالعلامة والبيان التجاري في القانون رقم 82 لسنة 2002 في شأن حماية الملكية الفكرية المصري؟, وصور الاعتداء على كل منهما, وسرق حمايتهما, والمبادئ المستحدثة في ذلك القانون, ومنها مبدأ المعاملة الوطنية, ومبدأ الدولة الأولى بالرعاية وغيرهما حتى نقدم للقارئ معلومات عن أحد أهم الموضوعات التي يتعامل معها في حياته اليومية.
