يعدّ علم أصول الفقه منهج البحث العلمي عند المسلمين حيث سمي بهذا الاسم الدال على الجمع (أصول) لاشتماله على ثلاثة أبحاث رئيسية وهي: 1-معرفة مصادر البحث، 2-معرفة طرق البحث، 3-شروط الباحث. وهي أركان البحث العلمي الذي يسعى لتحصيل الحقيقة بعيداً عن الأوهام وعن الهوى والتميز. ومن هنا يعرفه البيضاوي فيقول: أصول الفقه (هو معرفة دلائل الفقه إجمالاً، وكيفية الاستفادة منها وحال المستفيد). ضمن هذا الإطار يأتي البحث حول الحكم الشرعي عند الأصوليين. يتكلم المؤلف عن مقدمة ضافية تتناول مفهوم المصطلحات التي يحتاج إليها البحث الأصولي، حتى لو كانت منطقية أو لغوية أو كلامية، ويتكلم أيضاً عن المبادئ العشرة وعن الحكم وتقسيماته، يعالج مباحث هذا العلم على نحو هذا التقسيم: البحث عن الحجة وكيفية ثبوت المصادر، وكيفية فهم ما ثبت وقضاياه القطعية والظنية، وقضية الإلحاق ودراسة الاستدلال، ثم التعارض والترجيح، حتى يخلص المؤلف إلى مقاصد المكلفين وشروط المجتهد، ملحقاً بها الفتوى وأركانها.
