سعى هذا العمل إلى معالجة إشكالية القضاء القنصلي ومسألة السيادة في المغرب قبل الحماية. إن المؤسسة القنصلية بلورتها المعاملات التجارية الملاحية في العصور الوسطى، وطورتها الرأسمالية الميركانتيلية في العصور الحديثة. غير أن هاته المؤسسة بلورت آلية القضاء القنصلي كآلية خطيرة لاختراق سيادة الدول الٍرأسمالية، بما فيهما الدولتين العثمانية والمغربية. وبما أن الدبلوماسية الرأسمالية الهادئة والطويلة الأمد، المبنية على استراتيجيات تخدم المصالح الاقتصادية العميقة والتكتيكات المرحلية، جعلت المعاهدات التجارية والسياسية الموقعة بين المغرب والدول الرأسمالية تضمن للقضاء القنصلي حصانة دولية ومناعة تعاقدية لقناصل الدول الغربية في المغرب. من أهداف القضاء القنصلي الرأسمالي في المغرب استباحة القضاء والسيادة المغربيتين، خاصة في القرن التاسع عشر. ولعل معاهدات 1767مع الفرنسيين والإسبان، و1856 مع الإنجليز تجسد استراتيجة الاستباحة من خلال ثلاثية التمهيد والترسيخ وإهدار السيادة والاحتلال.
اعتمد العمل، في منهجه على قسمين: قسم نظري عالج محوري القضاء المغربي قبل فترة الحماية، والمؤسسة القنصلية منذ التشكل حتى تبلورها كمؤسسة سيادية لدى الدول الرأسمالية، وقسم تطبيقي عالج القضاء القنصلي في المغرب من خلال المعاهدات التي وقعها المغرب مع الدول الأجنبية، وتسلطه وإهداره للسيادة المغربية. و بما أن هذا العمل هو الأول من نوعه في حقل البحث التاريخي في المغرب، فإنه يبقى مفتوحا على تعميق الاشتغال على القضاء زمني الحماية والاستقلال، وذلك لتسليط الضوء على تاريخ القضاء بالمغرب والوقوف على مثبطات حداثته واستقلاليته وفعاليته الآنية.
