يعتبر التحكيم التجاري الدولي واحد من أهم وسائل تسوية المنازعات التجارية على الصعيد الدولي، بالإضافة إلى الوسائل الأخرى كالمفاوضات والتوفيق والوساطة والخبرة والمحاكمة الصغيرة، وهو وسيلة لتسوية المنازعات بشكل اختياري رضائي بعيدًا عن سلطة الدولة القضائية بهدف تفادي العيوب التي يتصف بها النظام القضائي الوطني مثل البطء في الفصل في الدعاوي المعروضة عليه والتسويف من الخصوم في الخصومة القضائية، فالتحكيم يمثل الفصل السريع في المنازعات بغير تسويف، فالطرف المتنازع الذي يحس بضعف موقفه في ظل القضاء التقليدي يلجئ إلى التسويف في المنازعات لتمتد المنازعة إلى سنوات طويلة لحين صدور حكم فاصل في النزاع الأمر الذي يؤثر سلبيًا على سير حركة التجارة الدولية، التي تتسم بالسرعة فالتأخير في الفصل المنازعات في منازعات عقود التجارة الدولية، يسبب خسارة قد تقدر بالملايين وهو العيب الذي لا يوجد في إطار اللجوء إلى التحكيم.
