قامت القوات العراقية في تاريخ 2/آب/ 1990 بدخول الكويت ومن ثم اعتبر العراق الكويت محافظة نابعة للعراق، وقد تذرع العراق بجملة من الذرائع لقيامه بالإحتلال لبعضها جذور تاريخية تعود لحالة الإستقلال كل من البلدين وأخرى تتعلق بالحدود المشتركة بين البلدين.
وكانت ردود الفعل الدولية سريعة جدّاً تمثلت في ما اتخذه مجلس الأمن من قرارات لمعالجة الواقعة وقد اتخذت أغلبية هذه القرارات في إطار الفصل السابع من ميثاق الأمم المتحدة يبلغ عدد هذه القرارات أحد عشر قراراً خلال أقل من ثلاثة أشهر، وقد عالجت القرارات حالة الإحتلال ومطالبات من العراق بإحترام قواعد القانون الدولي ومروراً بالقرار 678 الخاص بإستخدام القوة لإخراج القوات العراقية من الكويت ووصولاً إلى القرار رقم 687 المعروف بقرار وقف إطلاق النار.
وقد تناول هذا القرار مواضيع ذات أهمية تطرق بعض فقراته إلى مواضيع تدخل في صميم سيادة الدول والية معالجتها من خلال الآيات المكفولة دولياً.
وقد أثارت هذه القرارات والمواضيع التي تناولتها هذه القرارات خشية تعميق الخلافات المتأزمة أساساً بين البلدين، مما يستدعي النظر إلى الخلافات بنظرة قانونية فاحصة لتلافي حدوث أية منازعات جديدة خصوصاً العراق اتخذ خطوات جادة بعد سقوط النظام لحل المنازعات بين البلدين مما دعا مجلس الأمن الدولي إلى إتخاذ خطوة أساسية لتخليص العراق من الفصل السابع من الميثاق.
من خلال القرار رقم 2017 لعام 2013 لإخراج العراق من طائلة الفصل السابع من الميثاق وحصل القضايا العالقة في إطار الفصل السادس من ميثاق الأمم المتحدة.
