لا يمكن لأحد أن يؤرخ لهذا القرن دون أن يعرض لأحد أهم ظواهره، وهو إكتشاف مرض الإيدز في الولايات المتحدة الأمريكية عام 1981، والفيروس المسبب له عام 1983- والإحصاءات تؤكد أن المرض ينتشر بسرعة مذهلة: خمسة آلاف شخص يصابون به كل يوم، وأربعة عشر مليوناً من الرجال، والنساء، والأطفال مصابون بفيروس الإيدز فعلاً، وسوف يبلغ عدد الضحايا عام 2000 من 30 إلى 40 مليوناً.
والمرض يبدأ في جذوره كمسألة طبية إكلينيكية لكنه ينتهي بمشاكل قانونية تثير لدى المتخصصين في المسئولية المدنية أسئلة تتعلق بآليات المسئولية، ومدى توافقها، وتعويض ضرر جماعي، واسع الإنتشار يسببه فيروس لا علاج له، وسوف تنقسم دراستنا إلى فصلين- نتحدث في الأول منهما عن مرض الإيدز والتهاب الكبد الوبائي بين الطب، والقانون- وفي الثاني نعرض لتعويض الضحايا.
