يدور موضوع الكتاب حول موقف المُشرع العراقي في تعامله مع (غير المقيم) من حيث الخضوع، إلى سعر الضريبة والمساحات الضريبية والإعفاءات الضريبية، والسنة المالية وتقدير الضريبة وجبايتها عن غيره من (الشخص المقيم) عندما يتحقق لهؤلاء دخل نتيجة مزاولة النشاط؛ فالمكلف غير المقيم قد تتحقق له من جراء نشاطه دخولاً لا يستهان بها على الصعيد الضريبي، فما هو موقف القانون ممن يتهرب من أداء الضريبة لضعف الإحساس الوطني لديه.
من هنا، جاءت هذه الدراسة للإضاءة على المعاملة الخاصة التي يتوجب على المُشرع الضريبي أن يتعامل من خلالها مع غير المقيم.
يقسم الكتاب إلى ثلاثة فصول: يتناول في الأول مفهوم الإقامة وعناصرها وإقامة الشخص الطبيعي وإقامة الشخص المعنوي وأهمية التمييز بين المقيم وغير المقيم من الناحية الضريبية، أما في الفصل الثاني يبين الكتاب مبدأ التبعية الإقتصادية (الإقليمية) معياراً لخضوع دخل غير المقيم للضريبة العراقية، سواء كان دخل غير المقيم المتحقق داخل العراق ناتجاً من رأس المال أو العمل أو نتيجة إمتزاج العمل ورأس المال معاً (الدخل التجاري)، ويأتي الفصل الثالث والأخير في بيان تقدير وجباية الضريبة من غير المقيم منها تقدير دخل غير المقيم ومسؤولية تجاه السلطة المالية بناية عن غير المقيم، وكذلك تبيان الإعفاءات الممنوحة إلى الشخص غير المقيم وأخيراً كيفية جباية الضريبة من غير المقيم.
