لقد شعرت أن من واجبي أن أقدم للمكتبة القانونية هذه الطبعة التى تعكس تطور الحياة القانونية وما يصاحبها من تطبيقات قضائية، فالقسم الخاص من قانون العقوبات هو جوهره ومضمونه الحي، وإذا كان القسم العام من قانون العقوبات بما يضعه من مبادىء عامة يثير اهتمام الكافة سواء من المشتغلين بالقانون أومن رجال القضاء أو من غيرهم ـ فالقسم الخاص يضم بين دفتيه سائر النصوص التي تحدد الجرائم التى تقع اعتداء على المصالح التى يحيمها القانون بالعقوبة الجنائية، وهى النصوص التى تضفي حماية جنائية على مصالح المجتمع المختلفة؛ سياسية واقتصادية واجتماعية، فتعكس تطوره واحتياجاته. وتتكامل هذه النصوص مع أحكام القضاء وعلى قمته محكمة النقض بما ترسيه من معان لهذه النصوص تسجيلى مقاصدها وتؤكد حيويتها لمعاصرة الواقع بكل ظروفه ومختلف جوانب تطوره، فالقضاء ليس مجرد بوق يردد كلمة القانون، بل يطبقها بعد استجلاء معانيها، فيستشرف احتياجات المجتمع ومصالحه التى تعبر عنها نصوص القانون ويمنحها قبلة الحياة. ولا غرو، فإن أحكام القضاء تصدر باسم الشعب الذى يصدر القانون باسمه.
