إن الهدف الأسمى الذي تصبو إليه التشريعات الإجرائية الجنائية هو أن يصيب القاضي الحقيقة في حكمه سواء أكان بالإدانة أو بالبراءة، ولهذا يجب على القاضي قبل أن يصدر حكمه أن يكون قد وصل إلى الحقيقة، وتعني بالحقيقة هنا الوقوف على حقيقة الوقائع كما حدثت لا كما يصورها الخصوم، وهذه الحقيقة لا يمكن الوصول إليها إلا بعد البحث عنها وثبوتها بالأدلة والتوصل إلى نسبتها وإسنادها للمتهم معنوياً ومادياً، فالحق دون دليل يسنده هو كالعدم سواء بسواء.
ومن المبادئ الأساسية التي تحكم القوانين الردعية وخاصة قانون أصول المحاكمات الجزائية مبدأ لطالما رفع كشعار بالنسبة للدول ذات التوجه الديمقراطي، هذا المبدأ هو حرية القاضي الجنائي في الإقتناع.
لقد كان المبدأ في بداياته يعبر عن مفاهيم تتماشى والزمن الذي وجد فيه، وفي كل مرة تخطو الإنسانية خطوة نحو الرقي والتقدم الحضاري كلما كان لهذا المبدأ مفهوم معين، وكلما تراجعت الإنسانية في قيمها إلا وكان التأثير واضحاً على هذا المبدأ.
رغم أن هذا المبدأ قد ذاع صيته بعد الثورة الفرنسية مباشرة إلا أنه يعتبر من المبادئ التي تضرب في عمق التاريخ مع بداية الحضارات القديمة الأولى، وإن كان تطبيقه يأخذ صوراً مختلفة عن هذا الزمن، ومع ذلك فقد عرفه العراق القديم وكذا اليونان كما عرفته حضارة مصر وكذا الرومان، كما وجدت له أحكام في الشرائع السماوية وتخص منها بالذكر الشريعة الإسلامية، إلى أن أخذ شكله الحالي.
