قضى الله سبحانه وتعالى أن يجبل الإنسان على حب التملك وذلك مما أعطى للملكية العقارية أهمية كبيرة في حياة الشعوب باعتبارها مصدراً للثروة القومية، حتى أصبحت الملكية العقارية معتركاً بين أصحاب رؤس الأموال، يوجهون بها الإقتصاد القومي كما يشاؤن، لذلك تتعرض هذه الدراسة لإنتقال الملكية العقارية بالبيع، ومدى هذا الإنتقال لأهمية البيع العقاري، إذ لاتمر لحظة أو ساعة بدون بيع وشراء لعقار ما. حيث تتناول هذه الدراسة دور البيع في نقل الملكية العقارية، وأثاره على إلتزامات كل أطراف العقد بحالتيه الإبتدائي (قبل التسجيل) والنهائي (بعد التسجيل) وهل أصبح تسجيل عقد البيع العقاري شرطاً لنقل الملكية العقارية؟ ولا ننسى أثر ذلك على بيع الأماكن والعقارات التي تحت الإنشاء ومدى تنظيم المشرع المصري لعملية بيعها وإنتقالها بين الأفراد. والتذكير بجريمة بيع الأماكن وعمليات النصب والتزوير التي تقع جراء ذلك. وكذلك تتناول هذه الدراسة دور التسجيل ذاته في البيع العقاري ومراحل تطوره وأنظمته المتبعة في إجراءات الشهر والقيد، وصولاً إلى مرحلة القيد بالسجل العيني الإلكتروني، وآثاره القانونية المترتبة عليه، وعلى ذلك فإن خطة الدراسة تتمثل بإذن الله في: (الباب التمهيدي: ماهية البيع العقاري وتطور انتقال الملكية العقارية "القسم الأول: دور البيع في نقل الملكية العقارية (الباب الأول: دور البيع غير المسجل في نقل الملكية العقارية، الباب الثاني: دور البيع المسجل في نقل الملكية العقارية)، القسم الثاني: دور التسجيل في نقل الملكية العقارية (الباب الأول:النظم المعاصرة للتسجيل، الباب الثاني: القيد في ظل السجل العيني)"، الباب التمهيدي: ماهية البيع العقاري وتطور انتقال الملكية العقارية "الفصل الأول: ماهية البيع العقاري، الفصل الثاني: تطور انتقال الملكية العقارية").
