Ce manuel de droit diplomatique est le résultant d’un intérêt constant de l’auteur pour cette matière qu’il enseigne à l’U.L.B. depuis trente ans.
Ce manuel est une des rares analyses approfondies en langue française du droit diplomatique et en particulier de la Convention de Vienne de 1961 sur les relations diplomatiques à la lumiére de la pratique étatique et surtout judiciaire. Plus de 700 décisions sont recensées et analysées dans leur contexte.
La Convention de Vienne, à l’épreuve de trente ans d’application, resiste bien; mais là où elle n’a pas été précise, naissent des controverses auxquelles l’auteur essaie d’apporter une solution. Par example la question de l’immunité de juridiction de l’agent diplomatique demandeur, les relations entre immunité de juridiction et d’exécution de la mission et celles de l’Etat quelle représente, les sanctions des abus d’immunités.
L’auteur tente une synthèse de la notion d’acte de la fonction qui joue une role important dans toute cette matière et consacre un chapitre à une matière peu explorée: les immunités des chefs d’Etat.
L’auteur a pu mettre au mettre au point son manuscrit grâce à un congé scientifique subsidié par le Fonds national de la recherche scientifique qui se voit ici une nouvelle fois remercié.
