تعود قيمة هذا الكتاب إلى الفن الذي ينتمي إليه، وهو الخلاف الفقهي، وقد ذهب أغلب الفقهاء إلى أن المراد بالخلاف الفقهي: تغاير أحكام الفقهاء، وقد ذهب أغلب الفقهاء غلى أن المراد بالخلاف الفقهي: تغاير أحكام الفقهاء في مسائل الفروع... وواضح من التعريف: أن الخلاف ليوصف بالفقهي، ينبغي أن يكون واقعاً في أهله وهم الفقهاء، لا غيرهم. وفي محله، وهو أحكام مسائل الفروع، كأوصاف التعرّفات الشرعية العملية من طهارة وصلاة وغيرها، لا أحكام مسائل الأصول كالاعتقادات. ولأهمية الخلاف -أو علم الخلاف الشرعي- قال يحيى بن سلام: "لا ينبغي لمن لا يعلم الاختلاف أن يفتي، ولا يجوز لمن لا يعرف الأقاويل أن يقول: هذا أحب إلي".
والكتاب الذي بين أيدينا، هو كتاب في الموضع من صميم المتناول، كتاب ينتمي إلى علم الخلافات والتحرر العقلي وإطلاق الفكر للاجتهاد، كما أنه في الفروع الفقهية لا الكليّات، وتزاد قيمته في أنه يبرز الخلافيين الإمام مالك بن انس وتلامذته. ولأهمية هذا الكتاب وقيمته العلمية، حرص حميد محمد عمر من جامعة فاس بالمملكة المغربية وميكلوش موراني من جامعة بون بألمانيا على تقديم عملها التحقيقي المشترك في هذا الكتاب وذلك بهدف إنفاذ هذا العمل الذي يعود تأليفه إلى القرن الخامس الهجري من الضياع، كما واعتنى بإلحاق الكتاب بمقدمة عامة عرضا فيها نبذة عن حياة صاحب الكتاب، ووصف للنسخة التي اعتمد عليها في التحقيق، وتحديد للقيمة العلمية للكتاب، على ذلك عرضاه بعبارة واضحة، مختصرة تفي بمقصود القارىء.
